The Service provider shall take the technical and organizational measures, and formulates the rules of procedures, which are necessary for the enforcement of the rules regarding the data protection of the User.

The data must be protected by taking adequate measures against unauthorized access, changing, forwarding, publicizing, deletion or demolition, as well as accidental demolition and damage, and from becoming inaccessible as a result of the change of the applied technology.

During the data management, Service Provider must strive for the higher-level protection of the data, keeping up with the development of technology, always applying the most up-to-date data protection system.

Service Provider ensures that only people with the proper authorization can access the data of the User.

7. Users’ rights:

Based on the request of those concerned, Service Provider gives information on the concerned person’s data managed by Service Provider, on the purpose of the data management, its legal basis and period, as well as about that who manages the provided personal data and for what purpose. Service Provider is obliged to provide the information on the above in writing, within 30 days from the submission of the request.

Personal data can also be managed if acquiring the approval of the concerned is impossible, or would impose irrational cost, and the personal data is needed for the fulfilment of the legal obligation to which the data controller is subject to, or it is necessary for the purposes of pursuing the legitimate interest of the data controller or a third party, and the enforcement of such interest is in proportion with the limitation of the right to the protection of personal data.

If the personal data is collected with the approval of the concerned, the data collector, in the absence of a different act of legislation; for the fulfilment of the legal obligations applicable to it; or for the purpose of the enforcement of a third party’s legitimate interest, if the enforcement of such interest is in proportion with the limitation of the right to the protection of personal data, is entitled to keep managing the data without further approval, as well as following the withdrawal of the approval of the concerned.

The concerned my raise objections against managing its personal data, if the personal data management or forwarding is solely required for the fulfilment of the legal obligation concerning the data controller, or for the purposes of pursuing the legitimate interest of the data controller, data receiver or a third party, except in the case of compulsory data management, if the usage or forwarding of the personal data happens for the purpose of direct solicitation, survey or scientific research, as well as in other cases defined by the law.

User can also request for the correction of its personal data, and if the personal data is incorrect, and the correct data is at the disposal of the data controller, the Service Provider corrects the personal data.

In case the Service Provide finds the objection of the User to be well-founded, then it terminates the data management – including the further data collection – and shall lock the data, furthermore, it informs those who are obliged to take measures for the enforcement of the projection right about the fact of the objection, as well as about the measures taken on its basis. In case of the rejection of the request for information, correction, deletion or blocking, the Service Provider informs the concerned about the possibilities of the judicial remedies, as well as about turning to the Authority.

If the User does not agree with the Service Provider’s concluded decision, or if Service provider fails to meet the 30 days’ period open for providing information, the User – within 30 days from the notification of the decision, or rather the last day of the deadline – can go to court. The court shall give priority to the matter. The assessing of the trial falls within the competence of the tribunal. The trial – in accordance with the choice of the concerned – can be initiated before the tribunal of permanent address or place of residence.

If the court accepts the application, it bonds the Service Provider for providing the information, for the correction, locking, deletion of the data, for the destruction of the decision made by the automated data processing, and for taking the objection right of the concerned into consideration.

  • if the concerned requests for it based on the Act on the informational self-determination right and freedom of information (Infotv.);

  • the purpose of the data management seized to exist, or the period of storing the data determined by the law has expired;
  • the court or Authority ordered it.

Instead of deletion, the data controller locks the personal data, if the concerned requests for it, or if it can be presumed based on the available information, that the deletion would violate the legitimate interests of the concerned. The personal data locked in such way can only be managed until the data management purpose continues to exist, which eliminated the deletion of the personal data.
